Terms & Conditions

  1. Introduction

These Terms and Conditions (“Terms”) govern your use of this website (the “Site”), operated by Christine Monaghan, LLC a Massachusetts architectural firm (“we,” “us,” or “our”). By accessing or using the Site, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Site.

  1. Informational purposes only (no professional advice)

The content on this Site is provided for general informational and marketing purposes only and does not constitute architectural, engineering, legal, tax, or other professional advice. Use of this Site does not create an architect–client or other professional relationship between you and us. Before acting on any information on this Site, you should consult directly with a qualified professional regarding your specific project or circumstances.

  1. Eligibility and acceptable use

You may use this Site only if you are at least 18 years old and have the legal capacity to enter into these Terms. You agree that you will not:

  • Use the Site for any unlawful purpose or in violation of any applicable law or regulation
  • Attempt to gain unauthorized access to any portion of the Site or our systems
  • Interfere with or disrupt the operation of the Site or the experience of other users
  • Use any robot, scraper, or similar tool to access the Site without our prior written permission

We may suspend or terminate your access to the Site for any violation of these Terms.

  1. Intellectual property

Unless otherwise indicated, all content on the Site—including text, images, drawings, graphics, logos, layouts, and other materials—is owned by us or our licensors and is protected by copyright, trademark, and other intellectual property laws. You may view the content for your personal, noncommercial use only, and you may not copy, reproduce, distribute, modify, or create derivative works from any content without our prior written permission. Nothing on this Site grants you any license or right to use any trademark, logo, or other proprietary material displayed on the Site without our express written consent.

  1. User submissions and communications

If you submit any information, request, file, or other material to us through the Site (including contact forms and email), you represent that you have the right to provide that material and that it is accurate and not misleading. You grant us a nonexclusive right to use your submissions to respond to your inquiries and to operate, maintain, and improve the Site and our services. You should not submit confidential or proprietary information through the Site, because internet transmission may not be secure and use of the Site does not create a confidential relationship.

  1. Third‑party links

The Site may contain links to third‑party websites or resources that are not owned or controlled by us. These links are provided for convenience only, and we do not endorse or assume any responsibility for the content, products, or services of any third‑party sites. You access any third‑party websites at your own risk and are subject to their terms and policies.

  1. No guarantee of availability

We reserve the right to modify, suspend, or discontinue the Site or any feature of the Site at any time, with or without notice. We do not guarantee that the Site will be available at all times or free from errors, interruptions, or security vulnerabilities.

  1. Disclaimers

The Site and all content are provided on an “as is” and “as available” basis, without any warranties of any kind, whether express or implied. To the fullest extent permitted by applicable law, we disclaim all warranties, including any implied warranties of merchantability, fitness for a particular purpose, title, and non‑infringement, and any warranties arising out of course of dealing or usage of trade. We do not warrant that the Site or its content will be accurate, complete, current, error‑free, secure, or free of harmful components.

  1. Limitation of liability

To the fullest extent permitted by Massachusetts law, we and our owners, employees, and consultants will not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or relating to your use of or inability to use the Site, even if we have been advised of the possibility of such damages. To the extent we are found liable for any claim related to the Site, our total liability to you will not exceed one hundred dollars (USD $100), unless Massachusetts law requires a higher amount. Nothing in these Terms is intended to limit liability where such limitation is prohibited by law, including for willful misconduct or violations of Massachusetts General Laws Chapter 93A.

  1. Indemnification

You agree to indemnify, defend, and hold harmless us and our owners, employees, and consultants from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:

  • Your use of the Site
  • Your violation of these Terms
  • Your violation of any applicable law or the rights of any third party

This obligation will survive your use of the Site.

  1. Governing law and jurisdiction (Massachusetts)

These Terms and your use of the Site will be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to conflict‑of‑laws principles. You agree that any dispute arising out of or relating to these Terms or your use of the Site will be brought exclusively in the state or federal courts located in the Commonwealth of Massachusetts, and you consent to the personal jurisdiction of those courts. Nothing here is intended to limit the application of mandatory consumer protection laws that may apply to you.

  1. Compliance with professional regulations

We may be licensed as architects or design professionals in specific jurisdictions only, which may include Massachusetts and other states, as identified on the Site. Nothing on this Site is a solicitation to provide architectural or design services in any jurisdiction where we are not properly licensed or authorized. Any proposal or agreement for professional services will be set out in a separate written contract and may be subject to specific state or local laws and regulations.

  1. Changes to these terms

We may update or modify these Terms from time to time by posting the revised version on this page with an updated “Last Updated” date. Changes are effective when posted, and your continued use of the Site after changes are posted means you accept the revised Terms.

  1. Severability and waiver

If any provision of these Terms is held to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision of these Terms will not be deemed a waiver of that right or provision.
